Online store rules
The Rules define the general conditions and procedures for sales carried out by heelshub.fr located in Ukraine through the Online Store www.heelshub.fr (hereinafter the "Online Store") and define the terms and conditions of the service, provided by heelshub.fr, located in Ukraine, through free electronic services.
§ 1 Definitions
1. Business days are the days from Monday to Friday, excluding public holidays.
2. Delivery – is the actual delivery act:
To the Customer by the Seller through the Supplier of the Products, specified in the order.
3. Supplier – is the person or a company, cooperating with the Seller, in Products delivery process:
a) Courier company.
4. Password – is a sequence of letters, numbers or other symbols chosen by the Customer during the Registration process at the Online Store, used to protect an access to the Client's Personal Account at the Online Store.
5. Customer – is a person or a company, to whom the services are provided in electronic form in accordance with Legislative Rules and Regulations or due to the Sales and Purchase Agreement between the Customer and the Seller.
6. Consumer – is an individual who enters into a legal transaction with an Entrepreneur that is not directly related to his business or professional activities.
7. Customer’s Account – is a separate page for each Customer, launched on his behalf by the Seller after he has registered and concluded a Delivery Service Agreement of the Customer Account service.
8. Entrepreneur – is a self-employed person, legal entity or organizational unit to whom the law confers legal capacity, running business or professional activities on his own behalf and performs legal transactions directly related to his business or professional activities.
9. Rules – are main rules, mentioned here.
10. Registration – is the actual action made according to the specified Rules, necessary for the Customer to be able to use all the functions of the Online Store.
11. Seller – heelshub.fr with headquarter in Ukraine, Dnipro (49000); e-mail: info@heelshub.fr, who is also the owner of the Online Store.
12. Store Website – are websites on which the Seller manages his Online Store operating in the www.heelshub.fr domain.
13. Products – are Goods presented by the Seller through the Store Website, which may be the subject of the Sale and Purchase Agreement.
14. Data Medium – is a material or tool that allows the Customer or Seller to store his personal information, being able to provide access to this information in the future for a period corresponding to the purposes for which this information is used, and which allows to restore the stored information without changes.
15. Sale and Purchase Agreement – an agreement concluded remotely on the terms established by the Rules between the Costumer and the Seller.
§ 2 General Regulations and Use of the Online Store
1. All rights to the Online Store, including copyrights, intellectual property rights for its name, its Internet domain, the Store website, as well as templates, forms, logos, posted on the Store Website belong to the Seller and can be used in the way specified in accordance with the Rules and the Seller's written consent.
2. The Seller will do his best to make the use of the Online Store possible for Internet users using all popular web browsers, operating systems, types of devices and types of Internet connection.
3. The Seller uses the mechanism of cookies stored on the Customer's end device. Disabling cookies may cause difficulties in using the Store website.
4. To place an order via the Store website or by email and to use available services, the Customer must have an active User Account and active phone number and email address.
5. To place an order by phone, the Customer must have an active phone number and email account.
6. The Customer is not allowed to use the Online Store in a way that violates the law, decency or personal rights of third parties.
7. The Customer should use appropriate technical measures to minimize risks related to unauthorized access to data.
8. It is prohibited to use the Store resources for actions that violate the interests of the Seller.
§ 3 Registration
1. To create a Customer’s Account, free registration is required.
2. Registration is not required to place an order.
3. During registration, the Customer sets an individual Password.
4. By registering, the Customer accepts the Rules.
5. The Customer may consent to marketing data processing.
6. Consent may be revoked at any time.
7. After registration, the Customer receives confirmation and access to the Account.
§ 4 Orders
1. Information on the Store website does not constitute an offer under the Civil Code.
2. Orders may be placed online or by email 24/7.
3. Orders by phone are accepted during working hours.
4. Orders are placed by selecting Products and confirming payment and delivery.
5. Orders by phone are placed via the number listed on the website.
6. Confirmation is sent after agreement conclusion.
7. Orders by email require Product details and contact information.
8. The Seller confirms order details via email.
9. Placing an order constitutes an Offer.
10. Acceptance is confirmed via email.
11. The Agreement is concluded upon acceptance.
12. Conditions are confirmed via data medium.
§ 5 Payment
1. Prices do not include delivery costs.
2. Payment methods include bank transfer and WayForPay.
3. Payment must be made within 3 business days.
4. Failure to pay results in order cancellation.
§ 6 Delivery
1. Delivery is available in the USA and Europe.
2. Products are delivered without defects.
3. Delivery time is indicated on the website.
4. Delivery time is calculated in business days.
5. Products are delivered via Supplier.
6. Shipping confirmation is sent by email.
7. Customers must inspect parcels upon receipt.
8. VAT invoices are issued upon request.
9. Customers may receive feedback requests.
§ 7 Seller’s Warranty
1. Products are covered by warranty.
2. Customers may request repair, replacement or refund.
3. Defective products must be returned.
4. Warranty period is two years.
5. Complaints must be submitted in writing.
6. Complaints are processed within 14 days.
7. Claims may be submitted electronically.
8. Warranty does not apply to Entrepreneurs.
§ 8 Manufacturer’s Warranty
1. Products may be covered by manufacturer warranty.
2. Warranty details are provided on the website.
§ 9 Sale and Purchase Agreement Termination
1. Consumers may withdraw within 14 days.
2. Withdrawal period starts upon receipt.
3. Agreement becomes void after termination.
4. Refunds are processed within 14 days.
5. Return costs are borne by the Consumer.
6. Refunds are made using the original payment method.
§ 10 Free Services
1. Free services include Contact Form, Newsletter, Account, Reviews.
2. Services are available 24/7.
3. Seller may change service conditions.
4. Contact Form allows messaging.
5. Newsletter subscription is optional.
6. Customers may unsubscribe at any time.
7. Account allows order tracking.
8. Reviews are subjective opinions.
9. Access may be blocked for violations.
§ 11 Seller's Responsibility in Content Posting
1. Content reflects Customer opinions.
2. Seller holds rights to posted content.
3. Illegal content is prohibited.
4. Seller may remove violating content.
5. Customers are responsible for their content.
§ 12 Reporting Threats or Violations of Rights
1. Violations may be reported to the Seller.
2. Violating content is removed immediately.
§ 13 Protection of Personal Data
1. Personal Data protection rules are in the Privacy Policy.
§ 14 Termination of the Contract
1. Contract may be terminated at any time.
2. Customers terminate via written notice.
3. Seller terminates via email notice.
§ 15 Final Conclusions
1. Seller liability is limited.
2. Rules may be stored or printed.
3. Disputes are governed by Polish law.
4. Out-of-court dispute resolution is available.
5. Rules may be amended with notice.
6. Rules enter into force on 01.01.2024.
